2018 GLA250 didn't stop during front collision

Hi,

I purchased a GLA 2018 last year but unfortunately, my car got totaled in an accident( according to my insurance). It was a rear-end collision with the front car but my adjuster said that it is beyond repair so they will pay me the actual car value. I paid 32K and they are paying me 24K, I tried to talk to the dealership where I purchased a car and they provided me with another estimate of 27K but my adjuster said they won't pay me more. It never happened to me before so not sure if I can still fight with them. I was wondering if someone had a similar experience and help me out.

I was also thinking if I had a front collision prevention assist then why my car didn't stop before the collision? Is there a malfunction and should I contact Mercedes about it?

I am sorry I am not sure what to do at this point so need some guidance. Thanks in advance!

Very sorry to read Amber. Accidents are always unnerving, both when they occur and the aftermath hassle of dealing with insurance and the repair.

In MA we have "no fault" coverage, but in reality the insurance company of the individual who causes the accident pays the lion's share (the respective companies work it out between them). In a rear end collision the driver to the rear is considered the one who caused the accident even if the one in front suddenly jams on their brakes. The theory being that the trailing driver should have left adequate spacing and been in sufficient control to stop their vehicle prior to contact. The vehicle not auto-stopping alas is not an excuse. Not always fair but that's the law in my Commonwealth.

Some insurance companies are better than others but all are in business to make money and thereby will try to pay out as little as possible. If you truly believe yours is treating you unfairly you should consult an Attorney. Of course their fee will cost you money as well so you have to consider the return on that investment. Same goes for contacting Mercedes should they not be of assistance. It doesn't hurt to try yourself however (see below).

Be reminded that a year ago pre-owned vehicles were bringing pandemic-era top dollar, both to sell and to purchase. That bubble has since popped and hence a now more typical market valuation. You can go on any of the online car buying/selling services to ascertain the current value.

Again, sorry to read and all the best for a fair and speedy resolution. Take heart in that most everyone encounters an accident in their driving history and although always unpleasant one of life's learning experiences.

Have you confirmed that it is indeed "totaled"? That usually just means that it would cost the insurance company more than the $24k payout for them to fix it. Book value on cars lately do not reflect market prices so you wont find much to replace it for only $24k. So, it might be worth more to you to have it repaired. My father had an accident where he drove his jeep liberty right into the back of a landscaping trailer. The insurance company was going to total it out because the blue book value on the jeep was so low. My dad talked the autobody shop into fixing it for the payout price. Because it was going to cost the insurance company the same either way, they fixed it. Maybe if the blue book vs. repair cost gap is small, you could pay the difference?
